Recent Victories

  • An employer that subcontracted its janitorial work to save costs was ordered by an arbitrator to restore the work to the bargaining unit and to reinstate, with back pay, the worker whose job had been eliminated.  Although the union’s contract had no restrictions on subcontracting, and there had been instances of contracting out cleaning work in the past, the arbitrator agreed with the union that the contract’s recognition clause bars subcontracting for the purpose of obtaining cheaper labor costs.
  • Jury finds for Deputy U.S. Marshall.

    After a seven day trial a United States District Court jury found that former U.S. Marshall Anthony Dicchio had retaliated against Deputy U.S. Marshall Cynthia Bohn.  Total damages, fees and costs exceed half a million dollars.

    This victory came on the heels of a First Circuit Court of Appeals decision ruling the Deputy U.S. Marshall was entitled to a new trial.  The original trial judge had ruled against the Deputy Marshall, but after appeal by Segal Roitman, the Court of Appeals ordered a new trial.

  • SEIU Local 888 www.seiu888.org has become the first union in Massachusetts to obtain recognition through a private sector card check under the state’s new Written Majority Authorization law.

  • IUOE Local 4, www.iuoelocal4.org, recently won a major victory before the National Labor Relations Board, Region I.  On the heels of the highly controversial Oakwood decision, Region I found that the plant lead person was not in fact a supervisor.  The decision helped to pave the way for a successful organizing campaign.  The Union won the election by a wide margin.

  • Micah T. Drayton became associated with the firm on February 8, 2010.
  • Don Siegel, Paul Kelly, Ira Sills, Mary Sullivan, Burt Rosenthal, Shelley Kroll, and Anne Sills have been named New England Super Lawyers by Law and Politics magazine and Boston magazine for 2009.
  • Nikki Decter and Michael J. Doheny were named a Super Lawyer “Rising Star” for 2009. Mike has been reappointed to the Boston Bar Association Labor and Employment Law Steering Committee and has also been named co-chair of the Public Policy Sub-Committee.
  • Ira Sills has been appointed to the Advisory Committee of the Division of Labor Relations for the Commonwealth by Governor Deval Patrick.
  • Mary Sullivan has been named to the Advisory Council of the Commonwealth’s Division of Apprenticeship and Training by Governor Deval Patrick.
  • James Shaw has been chosen as the Labor Co-Chair of the Labor Relations Forum of the Labor and Employment Section of the Massachusetts Bar Association.
  • Nicole Horberg Decter has been named to the Board of Directors of the Lawyers Coordinating Committee of the AFL-CIO.  She has also been appointed to the Labor and Employment Law Steering Committee and has been named co-chair of the Labor and Employment Subcommittee.
  • Ira Sills was awarded the Labor Guild of the Archdiocese of Boston 2006 Cushing Gavin Award for “Excellence in Labor Management Relations Exemplifying Moral Integrity, Professional Competence, and Community Concern”, joining former Segal Roitman Awardees Robert Segal, Richard Coleman, Paul Kelly, and Don Siegel.

  • Don Siegel and James Shaw presented at the Construction Institute’s Conference, in Springfield, Mass., on Labor Standards on Federal and State Public Construction Projects and the efforts of the Obama administrations to implement Project Labor Agreements on federal construction projections on December 2, 2009.
  • Burt Rosenthal gave a presentation on the National Labor Relations Act and Chapter 150E of the Mass. General Laws for Massachusetts Continuing Legal Education at MCLE’s program on Employment & Labor Law Basics on October 21, 2008.
  • Mary Sullivan chaired a panel on the legal rights of hourly workers for MCLE on June 19, 2008.  Mary also chaired a panel entitled “Representing the Union Employee” at the New England Regional Conference of the National Employment Lawyers Conference in Boston, MA on May 10, 2008.
  • Indi Talwani spoke on the Family Medical Leave Act for union lawyers at the AFL-CIO Lawyers Coordinating Committee Conference in Seattle, Washington on May 19, 2008.

  • Don Siegel participated in two Roundtables at the International Foundation of Employee Benefit Plans Construction Industry Conference in September, 2007.  He spoke on Labor Management Cooperation and on the LM-10 - LM-30 filing requirements.
  • Shelley Kroll spoke at the 35th Annual Robert Fuchs Labor Law Conference sponsored by the Labor & Employment Law Sections of the Boston, Massachusetts, Connecticut, Maine, New Hampshire, Rhode Island and Vermont Bar Associations on October 18, 2007 at Suffolk University Law School.
  • Ira Sills was a panelist at a Future of Labor Forum entitled “The Future of Labor Relations on America’s Campuses”, held at Harvard University on October 2, 2007.
  • Mary Sullivan offered a presentation on fiduciary responsibility for apprenticeship fund trustees at the Annual Conference of the International Foundation of Employee Benefit Plans in Anaheim, California in November, 2007.
  • Nicole Decter presented a paper on the rights of hourly and immigrant workers at a panel entitled “Hourly Workers, Employee Rights, Employer Obligations, and High Stakes” for MCLE on July 12, 2007.
